What state do I file in military TurboTax?
From a tax standpoint, your State of Legal Residency (SLR) is considered your "domicile" or "resident" state as long as you are on active duty. Even if you are stationed in another state, you're still considered a resident of your SLR.
If you're in the military, you're probably taxed in your state of legal residence rather than in the state where you're stationed. Filing taxes while deployed can depend on your state of residence as well. To establish legal residence in a state, you usually must prove you live — and intend to continue living — there.
Under the SCRA, servicemembers retain the state they claimed when they entered active duty as their state of legal residence unless they take affirmative steps to change their state of legal residence.
"Home of record" is almost always the state where you first joined the military. Home of record (HOR) is an accounting term used by the military to determine a number of military benefits, such as travel allowances, transportation expenses, travel time to report to duty, etc.
The 2023 Veterans Auto and Education Improvement Act of 2022 allows the active-duty service member and spouse to file state income taxes based on one of three choices: The residence or domicile of the service member, the residence or domicile of the spouse, or the permanent duty station of the service member.
For tax years on or after 2018 through 2022, you may elect to use the same residence as your active duty spouse. For tax years 2023 and after, you may elect to use any of the following: The residence or domicile of the servicemember. The residence or domicile of the spouse.

A military state is one in which the government is directly run by the military. This can happen as the result of a coup, occupation or by some other means. Military governments are by nature undemocratic. However, sometimes a military government is put in place as a means of transitioning to democracy.
In order to change your state of legal residence you must be residing in the state that you wish to make your new legal residence. The fact that you are currently stationed in that state will be sufficient if you have established a home (living in a dormitory on base will not be sufficient).
Your physical presence in a state plays an important role in determining your residency status. Usually, spending over half a year, or more than 183 days, in a particular state will render you a statutory resident and could make you liable for taxes in that state.
What does state of residence mean?
The state of legal residence is where you reside. Each state determines legal residency differently.
A member can maintain the domicile or legal residence in the state the member resided before entering active duty. A member does not lose the domicile (legal residence) in a state when absence from that state is due to military orders.
You're a resident if either apply: Present in California for other than a temporary or transitory purpose. Domiciled in California, but outside California for a temporary or transitory purpose.

In the past several years, many states have passed legislation affecting taxes on military retired pay both to show appreciation to Veterans and to attract them to settle in their state after leaving the military. In 2021, Arizona, Nebraska, North Carolina, and Utah eliminated state taxes on military retirement pay.
Members of the military may qualify for tax benefits not available to civilians. For example, they don't have to pay taxes on some types of income. Special rules may lower the tax they owe or allow them more time to file and pay their federal taxes.
Home of Record.
Your home of record is the state recorded by the military as your home when you were enlisted, appointed, commissioned, inducted, or ordered in a tour of active duty. This is often the state you should continue to use as your tax home as you move from state to state (or overseas) on military orders.

If you are stationed away from your permanent home address, you will still pay taxes in your home state in most cases. Note: military spouses who work and live with their service member in a state other than their home state as a result of military orders may not have to pay income tax in the state where they work.

Why not use TurboTax 2024?
